Under and by virtue of the Power of Sale contained in a Security Deed given by Jason H. Jones to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR TAYLOR, BEAN & WHITAKER MORTGAGE CORP, dated December 28, 2006, recorded in Deed Book 1856, Page 272, Laurens County, Georgia records, as last transferred to OCWEN LOAN SERVICING, LLC by assignment recorded or to be recorded, Laurens County, Georgia records conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED FIFTY THREE THOUSAND AND NO/100 DOLLARS ($153,000.00); with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Laurens County, Georgia, within the legal hours of sale on the first Wednesday in January, 2013 the following described property:
ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING LOT EIGHT (8) OF THE JOHN M. DIGBY PROPERTY IN LAND LOT 251 AND LAND LOT 252 IN THE 18TH LAND DISTRICT OF LAURENS COUNTY, GEORGIA, CONTAINING 2.00 ACRES, MORE OR LESS, BEING BOUNDED NOW OR FORMERLY AS FOLLOWS: ON THE NORTHEAST BY LOT 9 OF SAID JOHN N. DIGBY PROPERTY; ON THE EAST BY YATES & DURDEN; ON THE SOUTHEAST BY LOT 7 OF SAID JOHN N. DIGBY PROPERTY; AND ON THE NORTHWEST BY THE SOUTHEASTERN MARGIN OF A COUNTY MAINTAINED DIRT ROAD.
SAID LAND IS MORE PARTICULARLY DESCRIBED ON A PLAT OF SURVEY PREPARED BY CHARLES M. ZEIGLER, LAND SURVEYOR, DATED JULY 9, 1984, RECORDED IN DEED BOOK 420, PAGE 495, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF LAURENS COUNTY, GEORGIA, WHICH PLAT IS BY THIS REFERENCE INCORPORATED HEREIN AS A PART OF THIS DESCRIPTION.
ALSO: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING LOT 7, BEING TRIANGULAR IN SHAPE OF THE JOHN M. DIGBY PROPERTY IN LAND LOT 251 AND LAND LOT 252 IN THE 18TH LAND DISTRICT OF LAURENS COUNTY, GEORGIA, CONTAINING 2.08 ACRES, MORE OR LESS, BEING BOUNDED NOW OR FORMERLY AS FOLLOWS: ON THE NORTHEAST BY LOT 8 OF SAID JOHN M. DIGBY PROPERTY; ON THE SOUTH BY LOT 1, LOT 2, LOT 3, LOT 4, LOT 5, AND LOT 6 OF SAID JOHN M. DIGBY PROPERTY; AND ON THE NORTHWEST BY THE SOUTHEASTERN MARGIN OF A COUNTY MAINTAINED DIRT ROAD. SAID LAND IS MORE PARTICULARLY DESCRIBED ON A PLAT OF SURVEY PREPARED BY CHARLES M. ZEIGLER, LAND SURVEYOR, DATED JULY 19, 1984, RECORDED IN DEED BOOK 420, PAGE 495, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF LAURENS COUNTY, GEORGIA.
LESS AN EXCEPT: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT 251 OF THE 18TH LAND DISTRICT OF LAURENS COUNTY, GEORGIA, CONTAINING 0.69 ACRES, MORE OR LESS, AND BEING PART OF LOT 8 OF THE JOHN M. DIGBY SUBDIVISION. SAID PARCEL IS MORE PARTICULARLY DESCRIBED UPON THAT PLAT OF SURVEY BY BILLY FLANDERS, REGISTERED LAND SURVEYOR, DATED JANUARY 8, 1991 AND RECORDED IN PLAT BOOK 7, PAGE 101, IN THE DEED RECORDS OF THE CLERK OF LAURENS SUPERIOR COURT. THIS IS PART OF THAT SAME LOT 8 OF THE JOHN M. DIGBY PROPERTY CONVEYED TO MONTY HESTER BY WARRANTY DEED RECORDED MARCH 18, 1988, IN DEED BOOK 508, PAGE 30, IN THE DEED RECORDS OF THE CLERK OF LAURENS SUPERIOR COURT.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ocwen Loan Servicing LLC, Attention: Home Retention Department, 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409, Fax 407-737-5693. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the parties in possession of the property are Jason H. Jones or a tenant or tenants and said property is more commonly known as 1178 Troup Lane, Dublin, GA 31021 .
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
