Under and by virtue of the Power of Sale contained in a Security Deed from ESTATE OF J.D. HOGAN AKA J.D. HOGAN, JR., DECEASED to THE BANK OF FITZGERALD dated March 30, 2000, and recorded in Deed Book 1113, Page 17, Laurens County Records, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door in Laurens County, Georgia, within the legal hours of sale, on the first Tuesday in December, 2012, the following described property:
All that tract or parcel of land containing 10.9 acres lying and being in Land Lot 117 of the 2nd Land District of Laurens County, Georgia, fronting on the most northerly margin of the right of way of Blackshear Ferry Road (County Road No. 436) as shown on a plat thereof signed by Larry C. Jones, Registered Land Surveyor, dated February 24, 2000, and recorded in Deed Book 1113, Page 16, in the Office of the Clerk of the Superior Court of Laurens County, Georgia, which plat and the record thereof are by reference incorporated herein and made a part of this description for the purpose of showing the courses, distances, location and boundaries of the aforesaid tract of land.
It should be noted that the aforesaid plat divides this tract of land into five lots, lying adjacent to each other, shown as Lots 1 through 5 on said plat and each lot has the acreage, courses, distances, location and boundaries as shown on said plat.
The debt secured by said security deed has been and is hereby declared due because of, among other possible events of default, failure to make payments in accordance with the terms of said note. The debt remaining in default, this sale shall be made for the purpose of paying the same, and all expenses of sale, including attorney’s fees, notice having been given of intent to collect attorney’s fees.
Said property will be sold subject to any outstanding ad valorem taxes, any matter which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is ESTATE OF J.D. HOGAN, AKA J.D. HOGAN, JR., DECEASED, or a tenant or tenants. The person who shall have the authority to negotiate, amend, and modify this loan is J.E. Kirkley, II, City President, Colony Bank, P.O. Box 797, Eastman, Georgia 31023 (478) 374-4739.
